The petitioner seek bail in a case registered for the offence punishable under Sections 341, 323, 326, 302/120B of the Indian Penal Code.

In pursuance to the order dated 25.05.2021, status report of trial in connection with Manigachhi P.S. Case No. 264 of 2015 has been received and kept at Flag-A, in which it is stated that charge-sheet was submitted on 07.02.2016 in Manigachhi P.S. Case No. 264 of 2015 against four accused persons including Vinay Sahni showing him as absconder. The record of other three accused persons was committed to the court of Sessions as S.T. No. 297 of 2017 in which trial is complete and is fixed for final argument. The record of Shri

Patna High Court CR. MISC. No.4775 of 2021(5) dt.17-08-2021 2/2 Vinay Sahni has been also committed as S.T. No. 111 of 2021 in which charges have been framed on 07.06.2021 inter alia under Section 302 of IPC. There are eight charge sheet witnesses in this case but the processes have not been issued against the witnesses to compel their attendance as the courts are running through virtual mode only.

Considering the present stage of trial and the fact that petitioner was declared absconder, I am not inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with Manigachhi P.S. Case No. 264 of 2015 pending before the court of the learned Sub-Divisional Judicial Magistrate, Darbhanga.

Accordingly, the application is dismissed. However, Trial Court is directed to expedite the trial as expeditiously as possible from the date of initiation of normal physical proceeding and /or through Video Conferencing. (Anjani Kumar Sharan, J) devendra/- U T
