Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. The F.I.R. of the occurrence of robbery is against unknown. Petitioner is in custody since 04.04.2019. Submission is that he was never put on Test Identification Parade during investigation, which is already complete, nor any incriminating article was recovered from the possession of the petitioner.
Prayer for bail was opposed on the ground that petitioner has got criminal antecedent.
Considering the fact that in this case there is no substantial material against the petitioner to detain him as

No.45373 of 2019(2) dt.25-07-2019 2/2 under trial prisoner furthermore, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Jadia Police Station Case No.22 of 2019, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
