Earlier anticipatory bail petition of the petitioner was rejected by this Court, vide order dated 04.03.2020 passed in Cr. Misc. No. 83933/2019.

It is alleged in the F.I.R. that on 07.08.2018 petitioner kidnapped two girls, namely, Pooja Kumari and Golu Kumari for illicit purpose and till date Pooja Kumari is traceless. It is submitted that the victim Pooja Kumari, on her recovery, and the victim Golu @ Goliya Kumari @ Kavita Kumari gave their statement under Section 164 Cr.P.C. wherein they have not alleged anything against this petitioner. In fact, Pooja Kumari has stated that she had gone to the house of her Bua whereas victim Golu @ Goliya Kumari @ Kavita Kumari has stated that she has married with this petitioner and living

Patna High Court CR. MISC. No.4419 of 2021(2) dt.10-02-2021 2/2 with him. Petitioner had not kidnapped them.

In view of the statement recorded under Section 164 Cr.P.C., the petitioner, above named, in the event of his arrest/surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Pupri, Sitamarhi in connection with Bajpatti P.S. Case No. 249/2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
