Informant was staying at her Naihar where she begotten a child, her husband, deceased came and stayed, it has been alleged that on 20.12.2013 Bhusan Kumar accompanied him at about 04:00 PM. In the evening hour she was informed regarding presence of deceased near the bank of river lying in unconscious state whereupon her family members took him to Mahesi Primary Health Centre and from there to Saharsa, where during course of treatment, he died. It has also been disclosed that there was some sort of dispute prevailing since before with the family of Bhusan Kumar. During course of investigation it is apparent that from paras-61, 62, 63 the witnesses have disclosed that deceased Jai Prakash along with Bhusan, Angad, Sheoji, Babloo thakur were junketing. Witnesses examined under para-19 and 20 have seen 3-4 persons running away from bank of river though have not claimed identification and in the aforesaid background, there happens to be absence of connecting material so far, this petitioner is concerned.
Patna High Court Cr.Misc. No.18126 of 2015 (3) dt.29-06-2015 Accordingly, petitioner Shivji Sharma is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Mahishi P.S. Case No.160 of 2013.
