The petitioner seeks bail in a case registered under Sections 279, 337, 338, 304(A) of the Indian Penal Code and Sections 37(b), 37(c) of the Bihar Prohibition and Excise Amended Act, 2016.

Allegedly, the petitioner was driving the truck rashly and negligently, as a result of which, the truck collided with the motorcycle. The rider of motorcycle received injury and in course of treatment, he died.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The

Patna High Court CR. MISC. No.48027 of 2019(2) dt.01-08-2019 2/2 petitioner is in custody since 11-05-2019. The petitioner was arrested in drunken state.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Parsa Bazar P.S. Case No. 147 of 2019 corresponding to Special Case No. 4536 of 2019.
