Mr.Amitesh Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 23-11-2021 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest in connection with Complaint Case No. 123(C) of 2018 for offences under Sections 323 and 420 of the Indian Penal Code and Section 138 of the Negotiable Instrument Act.

Learned counsel for the petitioners submits that the petitioners have offered to pay the balance amount to the complainant.

In the aforesaid circumstances, learned counsel for the petitioners undertakes that the balance amount shall be paid

Patna High Court CR. MISC. No.3493 of 2021(4) dt.23-11-2021 2/2 to the complainant in the court below within a period of four weeks from today and on such payment, petitioner shall be released on bail. Exact amount due to the complainant shall be informed by him to the petitioners and difference of amount shall be paid to the complainant. Bail bonds shall be furnished within the next two weeks and the court below shall verify payment of the balance amount by asking the complainant to be present personally in the court.

Till payment of the balance amount, petitioner shall not be arrested in connection with Complaint Case No. 123(C) of 2018 pending in the court learned A.C.J.M. - IV, Barh, Patna. With the aforesaid observation and direction, this application is allowed.
