01-02-2022 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Natwar P.S. Case No. 71 of 2020, registered for the offence under Sections 399, 402, 414 of the Indian Penal Code.

On a secret information that some miscreants have assembled to commit a crime, a raid was conducted and this petitioner and others, who were identified by the chowkidar, fled away after seeing the police party. Three motorcycles, a knife, three cigarettes, matchbox and packet of tobacco were recovered from the verandah of the school, where the miscreants have assembled.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case and petitioner has been identified by the chowkidar in the light of bulb, which is vague. Petitioner is owner of the Pulsar motorcycle, which was

Patna High Court CR. MISC. No.57479 of 2021(2) dt.01-02-2022 2/2 recovered there besides other two motorcycles. Petitioner has been remanded in this case on 25.01.2021 from Nokha P.S. Case No. 224 of 2020 and since then, he is in custody. Chargesheet has already been submitted.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Bikramganj, Rohtas in connection with Natwar P.S.
