The petitioner seeks bail in Chandi P.S. Case No.56/2014, registered for the offences punishable under Sections 304(B), 201, 34 of the Indian Penal Code.
The father of the deceased-Manisha Kumari alleged that his daughter was married on 5.05.2013 with Ajay Sah but in a week after her marriage, her husband and other in-laws began to torture his daughter for demand of dowry. On 7.07.2014, the accused persons killed his daughter and disposed of the dead body hurriedly in order to conceal the evidence.
Sri Pramod Mishra, learned counsel for the petitioner submits that during the course of investigation, except the informant, his wife and family members, other relatives of the
Patna High Court Cr.Misc. No.6404 of 2015 (3) dt.15-04-2015 2/2 informant and co-villagers of the petitioner have stated that the deceased was ill and consequently she died. Information was also given.
It appears that the wife of the petitioner died within one year and two months of her marriage with the petitioner and the parents of the deceased made very specific allegation against the petitioner that the dead body was cremated without informing the parents.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. The trial court is directed to expedite the trial and conclude the same positively within one year from the date of receipt of this order.
