====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-09-2024 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 302, 201, 120(B)/34 of the Indian Penal Code.

3. It is alleged that sister of the informant was married with co-accused Pramod Das in the year 2011 and from the wedlock, two children were born and thereafter, all the accused persons including this petitioner started committing torture to sister of informant due to non-fulfillment of demand of Rs. 2 lacs and one motorcycle, as dowry, and on 20.05.2023, the informant received an information that accused persons have killed his sister and disposed her dead-body.

4. It is submitted on behalf of petitioner that petitioner is brother-in-law (Bhaisur) of the deceased and he is separate in

Patna High Court CR. MISC. No.52585 of 2024(2) dt.20-09-2024 2/2 mess & property and has got no concern with the affairs of deceased & her husband. There is general & omnibus allegation of demand of dowry & committing torture against petitioner and no specific overt act has been alleged against him. It is further submitted that informant is not eye-witness to the occurrence. Thrust of the allegation is against husband of the deceased, who is already in custody. Petitioner has got clean antecedent.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Masaurhi at Patna in connection with Masaurhi P. S. Case No. 345 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
