The instant writ application has been filed for the following relief(s):- (i) For directing the respondent authorities for removal of encroachment from the public land i.e. rasta/ road pertaining to Khata No.23, Khesra No.148, which is being used by the petitioner and other people of locality for their ingress and egress, but the anti social elements of the locality have blocked the way out by making construction upon them.
(ii) For directing the respondent authority especially the respondent no.4 to ensure the
Patna High Court CWJC No.12100 of 2025(2) dt.15-06-2026 2/3 order dated 14.05.2025 passed by the SDOcum-public grievance redressal officer, Bagaha, West Champaran in its true spirit by removing the encroachment and obstacle which has been made over the public land and being used by the petitioner and people of locality for their ingress and egress.
(iii) For directing the respondent authority specially CO concerned to initiate land encroachment proceedings against the person responsible for encroachment act in view of the fact that the petitioner and others of the locality are being used that public land for their egress and ingress.
(iv) For also grant the other reliefs for which the petitioner is entitled in the facts and circumstances.
3. The petitioner is directed to file a fresh representation with regard to the encroachment, in question, giving full details of the persons, who have made construction over the land and creating obstruction over the public road by blocking the same.

It is expected that once such an application for removal of the encroachment is filed by the petitioner, then the Circle Officer, Bagha-II, West Champaran. will initiate the appropriate proceeding under Section 3 of the Bihar Public Land Encroachment Act, 1956 and, after giving notice to all concerned, necessary orders shall be passed, adjudicating the issues, in question, and once it is found that the land, in
Patna High Court CWJC No.12100 of 2025(2) dt.15-06-2026 3/3 question, is a public land and the same has been encroached by the private persons, the same shall be made encroachment free within the time so allowed under the statute.
5. It is expected that the entire exercise shall be carried out and concluded within the time stipulated under the Act from the date of initiation of proceeding under Section 3 of the Bihar Public Land Encroachment Act, 1956.
6. With the aforesaid observation and direction, the writ petition stands disposed of.
