Learned counsel for the petitioner is directed to remove the defect(s) as pointed out by the office within a period of four weeks.

The petitioner seeks bail in a case registered under Sections-342, 326, 307/34 of the Indian Penal Code and Sections25(i-b)A, 26, 27, 35 of the Arms Act. Prosecution case in short is that one Kundan Kumar was abducted by accused persons. It is further alleged that the accused persons opened fire which hit in his stomach and in thigh of the victim.

It has been submitted that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 11-03-2022. Charge sheet has already been

Patna High Court CR. MISC. No.48406 of 2022(2) dt.20-12-2022 2/2 submitted in this case. The petitioner has falsely been implicated in the present case. There is no allegation of assault alleged against this petitioner. Allegation of assault is against the co-accused namely Parasmani.

On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Bihar Sharif in connection with Deepnagar P.S. Case No. 336 of 2021.
