JUSTICE JITENDRA KUMAR ORAL ORDER 18-07-2025 The petitioner seeks bail in connection with Nayaganw P.S. Case No-109 of 2024, registered for the offences punishable under Sections 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code.

2. I Heard learned counsel for the petitioner and learned APP for the State.

3. It transpires that this is the second Regular Bail application on behalf of the petitioner. The previous bail application was rejected by this Court vide order dated 14.02.2025 passed in Criminal Miscellaneous No. 10123 of 2025, in view of the serious allegation and material on record. The petitioner has caused grievous injury on the head i. e., the vital part of the body of the victim.

4. It further transpires that there is no new

Patna High Court CR. MISC. No.48873 of 2025(2) dt.18-07-2025 2/2 circumstances except examination of three prosecution witnesses including the doctor in the trial and the petitioner is in custody for about nine months since 11.11.2024.

5. In view of the aforesaid facts and circumstances, particularly the serious nature of allegation and period of custody, I am not persuaded to enlarge the petitioner on bail at this stage.

6. The petition is dismissed accordingly.

7. However, learned Trial Court is directed to expedite the Trial and in case the Trial is not concluded within nine months, the petitioner would be at liberty to renew his prayer for bail.
