The petitioner is in custody since 02.12.2015 in connection with Daudnagar P.S.Case No. 243/2015 registered for offences punishable under Section 25 (1-b)a/ 26 of Arms act. The prosecution case is that the police lodged selfstatement on 1.12.2015 to the effect that they arrested one person ( petitioner) from whose possession, one country made pistol and a cartridge were recovered with one mobile.
It has been submitted by the learned counsel for the petitioner that he is innocent and has falsely been implicated in the aforesaid case and there is no criminal history. It has further been submitted that the petitioner has been charge sheeted, hence, there is no chance of tampering with the evidence.
However, learned A.P.P. for the State being opposes the prayer for bail and submits that the petitioner is
Patna High Court Cr.Misc. No.9532 of 2016 (2) dt.02-03-2016 2/2 named in the F.I.R.
Be that as it may, the above named petitioner Guddu Kumar @ Rohit Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- ( Ten thousand) with two sureties of the amount each to the satisfaction of learned S.D.J.M., Daudnagar, Aurangabad in connection with Daudnagar P. S. Case No. 243 of 2015 with following conditions:- i) One of the bailors will be the close relative of the petitioner.
ii) The petitioner will not indulge in similar or in any other offence.
iii) The petitioner will be well represented in the Court.
iv) In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the Court concerned.
