The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 8(c)r/w, 20(b)(ii)(c), 25, 29 of NDPS Act.

It is a case of recovery of 133 kg Ganza like narcotics substance from a pickup van bearing Reg. No. BR-53G-1598. Petitioner along with two other coaccused persons were apprehended on spot. It is submitted by learned counsel for the

He has no concern with the seized contraband or with the vehicle in question. He is neither the driver nor the owner of the said vehicle. A statement has been made in para 3 of the petition that he has no criminal antecedent. Moreover, the Petitioner is in judicial custody since 25.03.2022.

Learned APP appearing on behalf of the State vehemently opposed the prayer of the petitioner and submitted that the seized Ganza like substance is much more than commercial quantity as per NDPS Act and the petitioner is apprehended on spot. The seized contraband is tested positive for Ganza.

Having heard the learned counsel for the parties and considering the nature of allegation, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected. From perusal of the report of Trial Court, it
