The petitioner seeks bail in connection with Sessions Trial No.5 of 2014, arising out of Asthawan P.S. Case No.90 of 2013 registered under Sections 323, 341, 307, 504/34 and later on added Section 302 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that earlier the prayer for bail of the co-accused, Abadhesh Prasad alias Munna, and the petitioner was rejected by this Court by a common order dated 10.02.2014 passed in Criminal Misc. No.38196 of 2013 with Criminal Misc. No. 39640 of 2013 with an observation "for the present", which would appear
Patna High Court Cr.Misc. No.13550 of 2015 (2) dt.15-04-2015 2/2 from Annexure-„1‟ to this application. It is further submitted that the allegation against the petitioner is to cause injury through elbow on the chest of the informant, Mahesh Yadav, who died after 17 days of the occurrence. The petitioner is in custody since 03.08.2013.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Vth Additional Sessions Judge, Nalanda at Biharsharif, in connection with Sessions Trial No.5 of 2014, arising out of Asthawan P.S. Case No.90 of 2013.
