JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-04-2015 Both the above-said petitions arise out of Andhramath P.S. Case No. 21 of 2014 registered under Section414 of the Indian Penal Code and Sections-25(1-B)A, 26, 35 of the Arms Act and accordingly, both the above-said petitions are being disposed off by this common order.
Heard learned counsels for the petitioners as well as leaned Additional Public Prosecutor for the State. It appears that fire-arms and cartridges were
Patna High Court Cr.Misc. No.47543 of 2014 (2) dt.15-04-2015 recovered from respective possession of the petitioners for which, petitioners are in jail custody since 06-05-2014. Petitioners carry criminal antecedent of several cases but submission on behalf of the petitioners is that petitioners have already been granted privilege of bail in almost all the cases.
Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Andhramath P.S. Case No. 21 of 2014 to the satisfaction of Sri D. K. Tiwary, Judicial Magistrate-Ist Class, Jhanjharpur, Madhubani subject to condition that petitioners shall attend the trial court in persons, on each and every date for the period of 9 months or till conclusion of his trial, whichever is earlier and if, they fail to do so, on two consecutive dates without any reasonable cause and explanation, the learned trial court shall be at liberty to cancel the bail bonds of the petitioners.
