The petitioner seeks bail in anticipation of his arrest in connection with Ramgarhwa P. S. Case No. 76 of 2020, dated 19.04.2020, instituted for the offences under Sections 413, 414 and 286 of the Indian Penal Code.

The petitioner was seen fleeing away along with two other persons from a hut from where 760 litres of diesel is said to have been recovered. The diesel is alleged to be stolen property.

No.3703 of 2021(4) dt.22-10-2021 2/2 The learned advocate for the petitioner has submitted that he is an agriculturist and had stored the aforesaid diesel for the purposes of agricultural operations during the rainy days in Corona period. In order to ascertain the correctness of the aforesaid submission, this Court had called for the casediary on 09.09.2021 and had granted interim reprieve to the petitioner.

There is nothing in the case-diary to indicate that the diesel in question was stolen property. Regard being had to the afore-stated facts and taking into account the clean antecedents of the petitioner, the provisional bail granted to him by order dated 09.09.2021 is, hereby, confirmed. He shall remain on the same bail-bonds.

The application stands allowed.
