Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 323, 341, 379, 376D, 354, 504, 506/34 of the Indian Penal Code.
Earlier the prayer for bail of the petitioners was rejected by this court vide order dated 08.04.2015 passed in Cr. Misc. No. 14833 of 2015 but submission on behalf of the petitioners is that having more or less similar allegation, coaccused, Prakash Yadav has already been granted privilege of bail
Patna High Court Cr.Misc. No.10954 of 2016 (2) dt.18-05-2016 2/2 by a co-ordinate Bench of this Court vide order dated 02.03.2016 passed in Cr. Misc. No. 10370 of 2016. It is also submitted that up till now, only two prosecution witnesses could be examined and there is no likelihood of conclusion of trial of the petitioners in near future.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that having similar allegation, one co-accused has already been granted privilege of bail, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Sheikhpura in connection with Sessions Trial No. 656 of 2014 arising out of Sheikhpura (Mahila) P.S. Case No. 06 of 2014.
