The petitioner apprehends his arrest in connection with Majorganj P.S. Case No. 179 of 2014 registered under Sections 147, 148, 149, 323, 324, 307, 332, 353, 379, 333, 342, 427, 504, 506 of the Indian Penal Code. It is alleged that with the dead body of one Sanjay Kumar the miscreants were moving in the market and obstructing the smooth functioning of the administration and when the informant and other police personnel rushed there to maintain law and order then miscreants started pelting stones and tried to snatch the riffle of the police personnel. They also torn the uniform of some of the police personnel when some of the police personnel received injuries. The informant has also disclosed the name of 55 persons including the petitioner.

Patna High Court Cr.Misc. No.17788 of 2015 (2) dt.04-06-2015 2/2 Learned counsel for the petitioner submits that although petitioner has been named in the First Information Report but no overt act has been alleged against the petitioner.

Learned counsel for the petitioner further submits that similarly situated thirty co-accused have already been granted privilege of bail by this Court vide order dated 20.01.2015 passed in Criminal Misc. 30197 of 2014. Considering the aforesaid submissions, let the above named petitioner be released on anticipatory bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Sitamarhi in connection with Majorganj P.S. Case No. 179 of 2014, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
