However on repeat call, the petitioner was again not represented.

2. The present writ petition has been filed for setting aside the notice dated 28.08.2008 as contained in letter no. 243 issued by the District Engineer, District Board, Samastipur by which he directed the petitioner to deposit the price Rs. 2,63,734/- as an

Patna High Court CWJC No.11702 of 2013 dt.04-10-2018 amount for undistributed rice of 408 quintals 89 Kg. meant for Sampurna Gramin Rojgar Yojna as well as order dated 19.03.2013 passed in Case No. 91 of 2012 by the learned Collector, Samstipur by which the petitioner was directed to deposit rest amount of undistributed rice within a month and produce a certificate before Certificate Proceeding Officer.

3. Learned counsel for the respondents appears and states that the Enquiry Commission headed by Hon'ble Mr. Justice Udai Sinha (Retired) has now submitted its report and any further action in relation to recovery of the value of undistributed rice under the SGRY Scheme would abide by the decision of the State Government to be taken on the basis of such report.

4. Having regard to the stand of the respondents, the writ petition stands disposed of.
