2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 148, 149,384, 386, 302, 504, 341, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

3. F.I.R. has been lodged against 76 named and 20-30 unknown persons. The allegation against petitioner and other co-accused persons is that they demanded money and made firing, with the intention of creating panic, which hit on the chest of informant's husband, due to which, he died.

4. It is submitted that allegation of assault is general and omnibus and this petitioner has been made accused only on suspicion. Informant is not an eye witness of the occurrence and there is no specific allegation of causing fire-arms injury against the petitioner. It is further submitted that similarly situated co-

Patna High Court CR. MISC. No.50576 of 2023(2) dt.17-08-2023 2/2 accused have already been granted anticipatory bail by this Court vide orders dated 22.09.2022 and 06.12.2022 passed in Cr. Misc. Nos. 28004 of 2022 and 45792 of 2022.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Danapur, Patna in connection with Maner P. S. Case No. 752 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
