The petitioner seeks bail in Magadh University P.S. Case No. 10 of 2019, registered for the offence punishable under Sections 420, 467, 468 and 120(B) of the Indian Penal Code.
As per the prosecution case, this petitioner along with other accused persons after hatching up conspiracy and impersonating herself as informant prepared a forged sale deed of the land which belongs to this informant and fraudulently mutated in their names.
It is submitted on behalf of the petitioner that petitioner has not executed any sale deed and she never visited registry office. She has no concern with the aforesaid land or with the co-accused persons. Co-accused anyhow managed and obtained her photograph and misused it. Petitioner is illiterate
Patna High Court CR. MISC. No.4173 of 2021(2) dt.18-03-2021 2/2 lady and doing the work of labour for earning her livelihood. Petitioner is in custody since 14.09.2020 having clean antecedent. Chargesheet has already been submitted. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Gaya in connection with Magadh University P.S. Case No. 10 of 2019, subject to following conditions:- (i) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and in the event of failure on two consecutive dates without sufficient reasons, her bail bond shall be liable to be cancelled by the court below.
(ii) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (Prabhat Kumar Singh, J) vinita/- U T
