Mr. SRI NIRMAL KUMAR SINHA ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-01-2018 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner apprehends his arrest in connection with Bettiah Mufassail (Banuchapar) P.S. Case No. 358 of 2014, registered for the offences punishable under Sections 341, 323, 504/34 of the Indian Penal Code.

Allegedly, when the informant was cleaning her house, the petitioner caught her, pressed her mouth and got her down inside the house and torn her cloths. However, the informant cried and then her mother came but in the meantime the family members of the petitioner came and started assaulting the informant and her mother and the petitioner gave blow with fists on the stomach of the informant.

Patna High Court Cr.Misc. No.61208 of 2017(3) dt.25-01-2018 2/2 Submission is of false implication and that now good sense has prevailed between the parties. Compromise petition has also been filed in the Court below vide Annexure-2 and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. fairly submits that now good sense has prevailed between he parties and the matter has been compromised.

In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional District & Sessions Judgecum- Special Judge, Bettiah, West Champaran, in connection with Bettiah Mufassil (Banuchapar) P.S. Case No. 358 of 2014, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
