The petitioners apprehend their arrest in Excise case No. 201/2019, arising out of Parasbigha P.S. case No. 32/2019, registered under Section 30(a) of the Bihar Prohibition & Excise Act.
The police on secret information raided a place and apprehended one Dharmendra Choudhary. From that place situated near a canal 25 liters of country made liquor was recovered. Dharmendra Choudhary is said to have disclosed the names of the petitioners and stated that petitioners were also selling the liquor.
The learned counsel for the petitioners submits that it
Patna High Court CR. MISC. No.46001 of 2019(2) dt.25-07-2019 2/2 was Dharmendra Choudhary who was selling the liquor. The petitioners have got no manner of concern with Dharmendra Choudhary. Nothing has been recovered from the possession of the petitioner.
Considering the facts aforesaid and nature of allegation made against the petitioners and the fact that nothing has been recovered from the possession of the petitioners, the petitioners, above named, in the event of their arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IIcum-Special Judge, Excise Act, Jehanabad in connection with Excise case No. 201/2019, arising out of Parasbigha P.S. case No. 32/2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
