JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-09-2021 Heard Mr. Sharda Nand Mishra, the learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Belaganj P. S. Case No.66 of 2020, instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 379 and 504 of the Indian Penal Code.

The accusation in the F.I.R. is of the accused persons assaulting the members of the prosecution party. The victims have received only simple injuries. There is no specific accusation against the petitioner who has been falsely implicated in this case.

Apart from the petitioner having been named in the F.I.R., there is no other accusation against him. The petitioner as well as the informant are not only co-villagers but agnates as

Regard being had to the facts afore-stated, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIth, Gaya in connection with Belaganj P. S. Case No.66 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
