JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-03-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the complainant is languishing in jail since 15.12.2015 in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The basic accusation is of torture for non-fulfill of the dowry demand.
It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the informant. Though, the petitioner was earlier granted anticipatory bail on condition to make payment of `2,000/- per month to the complainant regularly but the bail bonds of the petitioner was cancelled on the ground of performing second marriage.
Patna High Court Cr.Misc. No.10177 of 2016 (2) dt.01-03-2016 2/2 Considering the nature of accusation and period under custody, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Sadar, Sitamarhi in connection with Bairgania P.S. Case No. 136 of 2013.
