====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-08-2025 Heard learned counsel for the petitioners, the State and the informant.

2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 318(4),316(2), 3(5) and 112 of the Bharatiya Nyaya Sanhita, 2023.

As per the prosecution case, petitioner no.1, who is cousin of the informant in connivance with other accused persons, fraudulently sold jointly owned ancestral land to a third party without informant's consent. It is further alleged that despite receiving Rs. 30 lacs from the buyer, petitioner no.1

Patna High Court CR. MISC. No.49680 of 2025(2) dt.07-08-2025 2/3 denied the agreement and got the land registered solely in his name. Petitioner no.1 and 2 are buyers, whereas petitioner no.3 is witnesses to the sale deed.

It is submitted on behalf of the petitioners that informant after payment of entire consideration money, has executed sale deed in favour of petitioners no. 1 and 2 which is evident from perusal of the sale deed itself. It is further submitted that after mutation of the land, petitioners have also leased out the land to Cigal India Ltd Company for its use as storage of construction material. Moreover, the dispute is of civil nature for which Title Suit No. 215/2023 has also been filed in which petitioners no. 1 and 2 are defendants.

5. Learned counsel for the State as well as the informant oppose the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate II, Danapur in Bihta Police Station Case No. 1084 of 2024, subject to the conditions laid down under section
