JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-12-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Desari P.S. Case No. 108 of 2017 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case due to village politics. Petitioner has no concern either with the bride or bridegroom. Petitioner had differences with the informant from before and due to that he has been implicated in the present case. Nothing specific has been alleged against this petitioner. Similarly situated co-accused persons have been granted bail by this Court vide orders dated 10.08.2017, 07.09.2017 and 22.09.2017 passed in Cr. Misc. Nos. 36392 of 2017, 38871 of
Patna High Court Cr.Misc. No.54527 of 2017(3) dt.21-12-2017 2/2 2017 and 42791 of 2017 respectively (Annexure-2 series). The allegations levelled are general and omnibus against all the accused persons. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, III, Vaishali at Hajipur in connection with Desari P.S. Case No. 108 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
