JUSTICE ARVIND SRIVASTAVA ORAL ORDER 12-12-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with buxar (Muffasil) P.S. Case No. 45 of 2017 registered for the offence punishable under sections 304B, 201 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner is the husband of the deceased and the allegations levelled against him are general and omnibus in nature. As a matter of fact, deceased died her natural death and in the cremation besides family members and villagers, informant also took part.
Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that there is specific allegation against this petitioner of assault and demand of motorcycle. During investigation, witnesses have supported the prosecution
Patna High Court Cr.Misc. No.52726 of 2017(3) dt.12-12-2017 2/2 case. Moreover, petitioner being the husband was very much responsible to keep his wife with full honour and dignity, in which he failed.
Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioner. The same is, therefore, rejected.
