JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-04-2015 Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State as also heard learned counsel, appearing for the informant. The petitioner is said to have given dagger blow on the chest of informant's husband, as a result thereof, informant's husband died then and there. The postmortem report of the deceased reveals that an incised would was found on the chest of the deceased.
Considering the facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioner on bail and, accordingly, his prayer for bail in connection with Nayagaon P.S. Case No. 95 of 2014, pending in the court of learned Chief Judicial Magistrate, Saran, Chapra stands rejected.
