JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-12-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 366(A), 34 of Indian Penal Code.

It is submitted on behalf of the petitioner that the victim in her statement recorded under Section 164 of Cr.P.C. has denied the prosecution case and has stated that she out of her own will solemnized marriage with the petitioner. She has disclosed her age as 19 years.

Considering the statement of the victim recorded under Section 164 of Cr.P.C., let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs.

Patna High Court CR. MISC. No.48493 of 2022(2) dt.13-12-2022 2/2 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Barh, Patna in Pandarak P. S. Case No. 45 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
