The petitioners seek pre-arrest bail in connection with Kesariya P.S.Case No. 333 of 2016 registered under Sections 341, 323, 324, 307, 313, 379, 504, 506 and 34 of the Indian Penal Code.

Regard being had to the delay of 40 days in filing the complaint case as also the FIR having been registered on the basis of the complaint referred under Section 156(3) of the Code of Criminal Procedure without there being any affidavit that the police refused to take any action under Section 154(1) and 154(3) of the Code of Criminal Procedure, in the event of arrest or

No.59248 of 2017 (2) dt.13-12-2017 2/2 surrender before the court below within four weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 11th Additional Chief Judicial Magistrate, East Champaran at Motihari in connection with Kesariya P.S.Case No. 333 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
