2. The petitioner is in custody in connection with Session Trial No. 702 of 2023 arising out of Balia Belon P.S. Case No. 102 of 2023 registered for the offence under Sections 302, 326, 201, 120(B) and 34 of the Indian Penal Code lodged on 07.08.2023 by the informant Abdul Khalib.

3. As per the prosecution story, the informant alleged that due to money transaction a panchayati took place and thereafter, the case is that the deceased was forcibly taken away by the accused, the informant went and search near the river, heard the scream of his brother and found that these accused persons have set him on fire after pouring petrol, he was rushed

Patna High Court CR. MISC. No.51034 of 2024(4) dt.21-10-2024 2/2 to the Sub-Divisional Hospital, Barsoi and then Sadar Hospital, Katihar. Later, he was referred to the hospital of Bhagalpur but died on the way. Accordingly, the F.I.R.

4. Allegation against these accused persons is/are of pouring petrol and putting the deceased on fire. It has been informed by learned APP that that the trial is on, it would be appropriate that the same is taken to its logical conclusion, accordingly, the bail application stands rejected.

5. Since the petitioners are in custody, the Trial Court shall ensure that the trial is taken to its logical conclusion without any further delay.
