The petitioner is accused in connection with Samastipur Rail P.S. Case No. 89 of 2014, registered under Section 379/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that Petitioner is not named in the F.I.R. The name of the petitioner is disclosed by Muntun Das showing his involvement and involvement of this petitioner in the present occurrence and on the basis of confessional statement of Muntun Das the stolen motorcycle was recovered from the house of Chhotu Ram, except the confessional statement, there is nothing against the petitioner to show his involvement in the present
Patna High Court Cr.Misc. No.13561 of 2016 (2) dt.07-04-2016 2/2 case. Moreover, the petitioner is in custody since 04.08.2015, but he has not been put on T.I.P, while the informant has disclosed the physic of the culprits in his written statement. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Railway Magistrate, Samastipur in connection with Samastipur Hasanpur Rail P.S. Case No. 89 of 2014. Out of two sureties, one surety must be the parents / close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
