Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered in connection with Sabour P.S.Case No. 144 of 2021 for the offences punishable under Sections 30(A) of the Bihar Prohibition & Excise Act, 2016.

As per the prosecution case, it is alleged that while the police was on patrolling duty, they intercepted a car and on search 121.365 liters foreign made liquor was recovered from dickey of the aforesaid car.

Learned counsel for the petitioner submits that petitioner is said to be the driver of the said car of which Gauri

Patna High Court CR. MISC. No.58177 of 2021(2) dt.07-04-2022 2/3 Shankar Co. Pvt Ltd is the owner and the petitioner had no knowledge about the liquor kept in the dickey of the car. It is next submitted that petitioner has absolutely clean antecedent and he is in custody since 30.05.2021 and there was no compliance of section 100 of the Cr.P.C. It is next submitted that during the course of investigation, nothing has come, which shows the connection of the petitioner of the said recovered contraband liquor.

The learned A.P.P opposed the prayer for bail of the petitioner and submits that in huge quantity of liquor was recovered from dickey of a car.

Having heard the rival contentions of the parties and taking into consideration the fact that, petitioner is driver of the vehicle and having no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II cum Special Judge, Vigilance ( Troop), Bhagalpur in connection with Sabour P.S.Case No. 144 of 2021, subject to the condition that one of the bailors will be the close relatives of the petitioner with further conditions which are as follows:- (i) The petitioner will cooperate in conclusion of the

(ii) He will remain present on each and every date of trial till disposal of the case.

(iii) He will not try to tamper with the evidence or intimidate the witnesses to delay the disposal of trial. (iv) In the event of default of two consecutive dates without any cogent reason, his bail bonds will liable to be cancelled.
