The case relates to commission of theft in a temple leading to registration of first information report under section 457 and 380 of the Indian Penal Code against unknown. The name of petitioner sprang up on the confession of c0-accused namely, Md. Shahid and Santosh Ram. It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner and statement has been made in paragraph 3 that the petitioner has no criminal antecedent.
