JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-12-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Complaint Case No. 1163 C of 2013 registered for the offence punishable under sections 302 and other allied sections of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. As a matter of fact the deceased died in a road accident for which copa P.S. Case No. 18 of 2010 was registered under section 302/34 of the Indian Penal Code. Petitioner was the driver of the alleged vehicle. Moreover, similarly situated co-accused person has been granted bail by this Court vide order dated 02.08.2017
Patna High Court Cr.Misc. No.54340 of 2017(2) dt.21-12-2017 2/2 passed in Cr. Misc. No. 33277 of 2017 (Annexure-3). Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, II, Biharsharif in connection with Complaint Case No. 1163 C of 2013 subject to the conditions laid down under section 438(2) Cr.P.C.
