This application has been filed on behalf of the petitioner, above named, for modification of the order dated 18.09.2017 passed in Criminal Misc. No.39847 of 2017 by this Court with regard to extend the period of surrender of the petitioner, above named, in the court below in connection with Chakmehsi P.S. Case No.26 of 2015.

Learned counsel for the petitioner, above named, submits that vide order dated 18.09.2017 passed in Criminal Misc. No.39847 of 2017 by this Court, the petitioner, above named, in the event of his arrest or surrender by him within six weeks from

Patna High Court Cr.Misc. No.60176 of 2017 (2) dt.24-01-2018 2/3 the date of the aforesaid order, was directed to be enlarged on provisional bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Samastipur, in connection with Chakmehsi P.S. Case No.26 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C. It was also made clear in the aforesaid order that if the petitioner, above named, submits the receipt showing the deposit of Rs.1,46,187/- to the Electricity Department within two months before the court below, his bail bond shall be confirmed and if he fails to do so, the court below would be at liberty to cancel his bail bond but due to communication gap, the petitioner, above named, could not surrender before the court below in time in connection with the aforesaid case and prays for extension of the period of surrender of the petitioner, above named, in the court below in connection with the aforesaid case.

In view of the aforesaid submission, let the period of surrender of the petitioner, above named, in the court below in connection with the aforesaid case be further extended for a period of four weeks from today.

The order dated 18.09.2017 passed in Criminal Misc. No.39847 of 2017 by this Court is modified to the aforesaid extent
