JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 394 of the Indian Penal Code.

Four unknown culprits snatched motorcycle from the informant and caused injury to him as well as his nephew when they made attempt to protest against the said loot. In course of investigation, the Investigating Officer got an information from S.H.O., Khizarsarai, District Gaya that three persons had been arrested with looted motorcycle and out of the aforesaid three persons, petitioner was one of them and subsequently, petitioner was remanded in this case and made his confessional statement. Submission on behalf of the petitioner is that

No.11870 of 2016 (2) dt.17-03-2016 2/2 petitioner was going along with his friends by the seized motorcycle and he was not aware that the seized motorcycle was stolen property. It is further submitted that when petitioner and two others were arrested by the officials of Khizarsari Police Station, the petitioner was remanded in some other cases also. It would appear from perusal of the impugned order that charge sheet has already been submitted, but the I.O. did not take pain to put the petitioner on Test Identification Parade. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Nawadah in connection with Hisua P.S. Case No.110 of 2015.
