The petitioners seek pre-arrest bail in connection with Amdabad P.S. Case No.137 of 2016 registered under Sections 302 and 120B/34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioners that the petitioners are not in any way related to the husband of the deceased. He submitted that the husband of the deceased Sk. Syed is in jail whereas father-in-law and mother-in-law, namely, Sk. Khalil @ Sk. Kalil and Bibi Budhiya respectively have already been granted pre-arrest bail by a Bench of this Court vide order dated 21.09.2017 passed in Cr. Misc. No.40256 of 2017.

Considering the submissions made above, in the event of arrest or surrender before the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri D. Singh, learned Judicial Magistrate, 1st Class, Katihar in connection with Amdabad P.S. Case No.137 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
