The petitioner seeks bail in a case registered for the offence under Section 272, 273, 34 of the I.P.C., Section 30(a), 36 of Bihar Prohibition and Excise Act and Section 8,20(b)(ii) (c) of N.D.P.S. Act.

18 liters of foreign liquor has been recovered from the Indica Car, of which, petitioner was one of the occupant and 500 gm. of Ganja was also recovered from the possession another occupant namely Raja Kumar.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent and he is in custody since 17.08.2021. Investigation is complete.

Patna High Court CR. MISC. No.57869 of 2021(2) dt.17-12-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation, clean antecedent and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II cum Special Judge, Excise Act, Muzaffarpur in connection with Ahiyapur P.S.
