The petitioner has filed the instant application for grant of regular bail in connection with Siwan Town P.S. Case no.261 of 2020 registered under section 379 of the Indian Penal Code. As per the allegation in the F.I.R., it is stated by the informant that he found his Bolero vehicle, which was registered in the name of his wife, missing from the place where it was parked.

It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. The name of the petitioner transpired in course of investigation when the stolen vehicle was found in possession of the petitioner for which Siwan Muffasil P.S. Case no.370 of 2020 was registered. It is

No incriminating article has been recovered from his possession and he has remained in custody since 20.9.2020. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for about 10 months and the investigation in the case having concluded, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Siwan Town P.S. Case no.261 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan.
