The petitioner is languishing in jail since 18.10.2015 in a case registered for the offences punishable under Sections 20, 22, 23 and 24 of the NDPS Act.
From the motorcycle of the petitioner while he was travelling on the Nepal Border, 5 kg. ganja were recovered. It is submitted by learned counsel for the petitioner that the petitioner had no knowledge about ganja being kept in his motorcycle. It is further submitted that investigation has already concluded. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
