2. The petitioner apprehends his arrest in connection with Dumariyaghat P.S. Case No. 100 of 2023, registered for the offences punishable under Sections 341, 323, 324, 307, 379, 447, 34 of the Indian Penal Code.
3. As per allegation, on 12.04.2023 at about 9:30 PM co-accused Rakesh Yadav and Mukesh Yadav armed with weapons in their hands came to the house of the informant and started abusing the informant and when the informant raised objection, they started assaulting him. When the wife of the informant came to save him, accused Sita Devi, the petitioner Mahesh Patel and Manoj Patel holding weapons in their hands
Patna High Court CR. MISC. No.50189 of 2023(2) dt.25-08-2023 2/2 came and started assaulting the informant. The petitioner with an intention to commit murder gave iron-rod blow on the head of informant due to which he sustained injury.
4. Learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent. Good relations have been restored between the parties and they have compromised the case. The injuries are simple in nature.
5. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Dumariyaghat P.S. Case No. 100 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C.
