2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 324, 427, 504 and 506/34 of the Indian Penal Code to which Section 307 was also added subsequently.
3. As per the prosecution case, while the informant went outside to attend the call of nature, all the FIR named accused persons pushed him. Sadab gave a farsa blow on the head of the informant causing head injury. Aman and Arbun gave knife blow to Muntazir causing injury on his back.
4. Learned counsel for the petitioner, submits that the petitioner is innocent and has falsely been implicated in this case. The present case is a retaliatory measure intended to save
Patna High Court CR. MISC. No.50332 of 2024(4) dt.16-01-2025 2/2 their skin from Jokihat P.S. Case No. 480 of 2023 lodged by brother of petitioner against informant and others. There is delay of four days in lodging the FIR. Injury caused by petitioner is simple. Petitioner claims clean antecedent.
5. Learned counsel for the State has opposed the prayer for bail.
6. In view of the above facts and circumstances of the case, in the event of arrest/surrender within a period of eight weeks from today, let the petitioner, above-named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in connection with Jokihat (Mahalgaon) P.S. Case No. 472 of 2023 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
