JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner has been made accused in this case on the ground that in course of investigation, looted articles were recovered from the tent of one co-accused, Baliram Baidh and petitioner was also arrested at the time of recovery along with other accused and put his signature on the seizure list. Moreover, according to prosecution case itself, the aforesaid recovery was made from the tent of Baliram Baidh and not from possession of the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.9721 of 2016 (2) dt.01-03-2016 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 938 of 2015.
