Petitioner is named in the first information report and in course of investigation, he was arrested and confessed to this extent that in the night of 23.07.2014, he had gone in the house of the deceased but brother of the deceased noticed him and raised alarm upon which altercation took place between the family members of the deceased as well as his family members and thereafter, he came to his home. The petitioner also confessed that in the next morning he learnt that deceased was missing from her house and after one day, the dead body of the deceased was found

The contention on behalf of the petitioner is that the deceased was in love with petitioner and on invitation of the deceased petitioner had gone to her house on 23.07.2014 and as a matter of fact, when petitioner and deceased were caught by the family members of the deceased and the affair of petitioner and deceased became public, the informant chastised and tortured the deceased and being fed up with the behaviour of the informant deceased committed suicide.
Admittedly, not a single witness claimed to have seen the petitioner taking away the victim on the alleged date of occurrence and except suspicion there appears to be nothing against him.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class, Begusarai in connection with Bachhwara P.S.Case No. 131 of 2014.
