JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 08-08-2023 Heard Mr. Hemant Kumar Jha, learned counsel appearing on behalf of the petitioner; Mr. Md. Nadim Seraj, learned counsel appearing on behalf of the L.N. Mithila University and Mrs. Binita Singh, learned SC-28 for the State.

2. Mr. Md. Nadim Seraj, learned counsel for the University submitted that on perusal of 'Annexure-1' to the writ petition it appears that the husband of the petitioner has already been paid on account of following heads:

(I) Pension.

(II) Family Pension.

(III) Dearness Allowance.

3. So far as the payment relating to gratuity and unutilized earned leave amounting to Rs. 20,00,000/- and Rs. 28,21,866/- respectively, admitted by the University as would appear from 'Annexure-1' a letter dated 27.02.2023 has been forwarded by the Registrar of the University.

Considering the said fact, Mr. Nadim Seraj, learned counsel for the University submitted that the petitioner may be advised to file a detailed representation before the Registrar of the Lalit Narayan Mithila University, Darbhanga for making payment of admitted dues on two heads as contained in letter dated 27.02.2023.

5. Learned counsel appearing on behalf of the petitioner has no objection.

Considering the submission made on behalf of the University, the petitioner, if so advised, may file a detailed representation before the Registrar of the Lalit Narayan Mithila University, Darbhanga, who has admitted that petitioner is entitled for gratuity of Rs. 20,00,000/- and unutilized earned leave amounting to Rs. 28,21,866/-.

7. In case, representation is filed on behalf of the petitioner, the Registrar of the Lalit Narayan Mithila University,

Patna High Court CWJC No.10475 of 2023 dt.08-08-2023 3/3 Darbhanga, must ensure to make payment of the admitted dues as claimed by the petitioner in terms of Memo No. C/PO/1955 of 2023 dated 27.02.2023 of the Registrar of the Lalit Narayan Mithila University, Darbhanga.

8. The admitted dues must be paid within a period of six weeks from the date of communication of the order.

9. With above observation and direction, the present writ petition is disposed of.
