2. The petitioner is in custody in connection with Khaira P.S. Case No. 23 of 2012 for the offence punishable under sections 498(a), 494, 467, 420, 120(B) of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.

3. As per the prosecution story, the informant alleged that he was married to Nazim Ansari, when she went to matrimonial house, Mumtaz Miyan and other abducted her which led to registration of Khaira P.S. Case No. 250/210. After that, when she went to the matrimonial house, they started torturing her physically and mentally. This led to the FIR.

4. Learned counsel for the petitioner submits that earlier, he was granted bail but due to the absence of proper appearance before the concerned Court, non-bailable warrant

Patna High Court CR. MISC. No.50139 of 2025(2) dt.11-08-2025 2/3 issued which resulted into his custody since 16.06.2025. The submission is that the petitioner shall be ensuring his regular presence in the Trial Court.

5. Learned APP though opposes the prayer for bail submits that he is seventy years old.

6. Taking into account the fact as also his period of custody and an undertaking has been given that he shall be diligently appearing in trial, in that background, this Court is inclined to extend him the privilege of bail with conditions.

7. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned SDJM, Jamui in connection with Khaira P.S. Case No. 23 of 2012 subject to the following conditions:

(i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iii) the petitioner shall in no way try to induce or

(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Vijay Singh/- U T
