JUSTICE BIRENDRA KUMAR ORAL ORDER 15-11-2021 Let the defects, if any, be removed within four weeks after complete start of the physical Court. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in connection with Mahila P.S. Case No.63 of 2019, registered for the offences punishable under Sections 323/379/ 498A /504 /506 /34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

This is a case under Section 498A of the Indian Penal Code.

Submission of the petitioner is that a divorce case has been compromised between the parties and matrimonial relationship was restored vide order at Annexure-2.

No.3287 of 2021(2) dt.15-11-2021 2/2 In the aforesaid circumstance, there is no reason that criminal case would continue if the wife-complainant appears before the Court-below and prays for withdrawal of her criminal case. The petitioner is directed to surrender before the Court-below in presence of his wife and the Court-below shall consider the prayer for regular bail without being prejudiced by the order of this Court.

With the aforesaid observation, the prayer for anticipatory bail is disposed of.
